Sender-Inner Maria Ruth writes: "I am an avid collector (and embroiderer) of vintage embroidery patterns, and when I came across this one (it originally said "Sunday") I thought, "Oh, no, that looks like Caturday to me!"
…To use it, one would print off the Caturday_transfer.jpg, trace over it with a special embroidery transfer pencil (available from any craft store) and iron it onto a piece of cloth. I just made the "flipped" image so you can see what it looks like once it’s ironed on.

what a neat pattern and yes I agree with the sender inner its definatly a Caterday design. Now If I only had the patience to actually make one.

You’re infringing on copyright. Changing on letter does not change that. These are still available through Aunt Martha’s, the company that made most of these transfers back in the day.

There are lots of cute- and weird- vintage patterns for free on mytransfers.blogspot.com from companies that are out of business. She avoids ones like Aunt Martha’s that are still around.
I got interested in embroidery just a few months ago, and started looking for vintage patterns online just last week, so I was surprised to see this on CO. Maybe the world really does revolve around me and my interests. Hee!
Okay, here may be the dumbest question of the day. How does someone start doing this? We’re talking about someone who knows little, or may have known little in a long ago time. Tell me it’s simple.(new hobby comin’ up?)

Allie – Does Aunt Martha’s make a Kitten sleeping in a bed design? The design does have an Aunt Martha type of design to it, so I wouldn’t be exactly suprised if it was a redesigned Aunt Martha, but I don’t remember a sleeping cat…

Hey I have this pattern! (minus the Caturday)but I don’t remember if it was Aunt Martha or not-probably though because that’s the only kind my grandma bought and it was she who taugh me to embroidery…I made this as a pillow case when I was 6! Super easy pattern to follow! Yeah embroidery!

I can’t say for sure whether it is a copyright infringement (as embroidery isn’t my thing), but it is a serious issue. Designers work long and hard on patterns (whether embroidery, knitting, sewing, whatever), and have rules about how they can be used. It’s not snark, it’s protecting yourself and other artists.
That said, it is a very cute pattern and reminds me of the Youtube video of the smush-face kitty waking up and rubbing his eyes.

It could be Vogart, Aunt Martha’s, Workbasket, or McCall’s if it was taken from a commercial pattern. All of them made embroidery patterns like this.

SayYesh – There are two places online that I suggest you look for help. The about.com website has a lot of information about crafts. And I sure the Embroidery Guild of America (do a search) will have information and links. Many local libraries have groups dedicated to needlework of various kinds. (as a matter of fact, all the libraries within a 20 mile radius of me have one of some sort). Often at these groups there are many experienced peeps who would like to teach/help people learning the craft.

Chances are this image is in the public domain now. Without getting too technical, copyrights issued before 1978 had shorter terms–generally a maximum of 56 years. Since it was published in the 40’s, the maximum time of protection has expired.

While I’m not a copyright lawyer, I don’t believe this is copyright infringement. This particular pattern was created in the early 30s, according to the earliest versions of the vintage Monarch patterns I saw online. The artist was probably commissioned or employed by Monarch, which means they weren’t credited. The copyright for the artwork probably expired recently (70 yrs after first publication) and the company would likely have no claim, even if they still existed.

I thought the pattern was adorable. And thank you for sharing. About the comment of the copyright…Frankly, yes I’ll be using the pattern. But this picture has revived an interest in an old hobby. I’ll be checking the legit patterns as well. If I didn’t see this pattern I might not be cruising legit websites (thanks for the address) – so there are winners all around.

The whole concept of copyrighting images seems vague in this our digital age. But then, I know less about copyrighting than I do about embroidery.
Some of these people that come here…they must be the most stressed out people on earth…they could make a toothpick into an object of controversy!
Non-embroiderers who want to get started: after you’ve transferred the design according to Maria Ruth’s instructions, put the fabric in an embroidery hoop. This design is really well suited for simple French knots, described on any embroidery how-to site. You just make a knot on each dot. That’s how I’d do it, if I still embroidered.

The patterns are no longer avaliable through Colonial Patterns Inc, the owner of Aunt Martha’s. They seem to have discontinued this particular pattern at some point. These particular patterns (going by the link provided by Allie) are no longer produced and a quick search shows them showing up at vintage resellers.
Finding it for sale at a vintage reseller does NOT offer proof of copyright owned by Colonial Patterns Inc. It only offers proof that they were, at one point, produced and sold by Colonial Patterns Inc, likely in the 30’s or 40’s. The copyright may well have long run out.
Infringement would only really come into play if a) the copyright is still in effect or has been renewed and b) this was offered at a price.
Hey peeps just got the scoop from my brother the lawyer (He specializes in copyright and pattens(sorry if my spelling is off its been a long night)) Anywho he said that since this was done in the 40’s or 50’s and they didn’t renew the copyright it would now be public domain. He said the only way for this to be infringement was if they did renew. He said to check and see if the picture had a copyright on it.
He also said that the person who made this probably wouldnt get into that much trouble if it was copyrighted because she was not claiming this as her own. She changed one word and put it on a free website for people to download as needed. Because she is not charging for this and because the copyright is probably out of date and the pattern is now indeed public domain then Maria Ruth is perfectly fine doing what she did.
Man I alway knew it would come in handy some day having a brother who does this kind of thing…even if i did have to interrupt his big meeting with Nike over a patten issue…oops
So yeah very cute pattern.

All in all its up to the company to deal with this…9 times out of 10 they are not going to get anything out of Maria Ruth even if they did pursue the matter. Happens all the time.
Just a point here – the website that was pointed out is selling “copies” of these – so, isn’t this too – some kind of infringement?
Also, you’re going to tell me that back in 1949 when Aunt Martha sat down to embroider something that she didn’t perhaps change it sometimes, someway, somehow?
Oh and I think the cross-eyed cat on the ad makes up for the ad itself.

I am a copyright lawyer, and my argument would be that the new design is protected by the concept of fair use. The creator is not making any money off her ‘Caturday’ interpretation, and the concept taken as a whole is clearly parody.
Goofy stuff – and never a good idea to wildly launch a claim of copyright infringement unless you:
a) created the work yourself *and* are annoyed (check Creative Commons for some common sense of this topic)
b) consult an attorney

a nice piece of cotton or cotton polyester blend cloth
a pair of scissors
and you are up and running
IT is actually a quick and easy and fun craft and easily carried with you in the car or on train or bus.
But not a plane! No needles or scissors! Don’t embroider in the air.

Allie, Maggie and anyone else on the subject of copyright infringement. I’m a lawyer (albeit English) so I know how important it is to protect people’s legitimate interests. However, I will now visit the web-sites mentioned, especially anything “Aunt Martha” and probably buy something, since I embroider (badly) and do cross-stitch (a bit better). So, in her own way, the sender-inner will certainly generate more revenue for “Aunt Martha”, at least from this peep.

For making pictures into counted cross stitch (photos and stuff) plenty of software is out there.

this onto a pillowcase for one of my toddlers (back in the day). Ah, the memories. My kid’s pillow case had a lion, a giraffe and a camel. Sigh!!
Has nobody mentioned candlewicking? I think this would be perfect. A nice understated embroidery – tone on tone, maybe candlewicked in cream on an off-white linen. Very retro!!

The design rules, whether it was appropriated or not…and even if it was, it won’t stop me from embroidering it on a t shirt! (BTW, I have also done my own embroidery design of Chessie the cat, since I couldn’t find a commercial design. Wow, last week it was crochet, this week embroidery!
